The Department of State Lands (DSL) has recently adopted new removal-fill rules.

Under Oregon’s Removal-Fill Law and Section 404 of the federal Clean Water Act, impacts to aquatic resources require a permit from DSL and the U.S. Army Corps of Engineers-Portland District. Mitigation requires a series of steps to eliminate or reduce impacts of a proposed project- a process called mitigation sequence. The sequence includes avoidance, minimization, and compensation for unavoidable impacts.

Rules have changed to accommodate for the federally adopted 2008 rule the Final Compensatory Mitigation Rule– which promotes a watershed- and function-based approach to compensatory mitigation.
