On Friday, June 17, 2022, the Oregon Health Authority Oregon Psilocybin Services Section held a webinar in partnership with the Association of Oregon Counties (AOC), on Ballot Measure 109, the Oregon Psilocybin Services Act (Oregon Revised Statutes Chapter 475A). The webinar included a brief overview of Ballot Measure 109 and an opportunity to ask questions about provisions related to local government.

Of important note:

  • Counties are automatically opted in to the psilocybin program unless voters approve an opt out at a general election, the next one being November 8, 2022.
  • Proceeding with an opt out ballot measure requires several steps in order to file a ballot title with the county clerk by the required August 19 deadline.
  • Repeal of an opt out ordinance does not require an election.
  • AOC encourages county boards of commissioners to work with county counsel and planning department staff to determine the best path forward.

About the Oregon Psilocybin Services Section: This is a new section housed within the Oregon Health Authority Public Health Division’s Center for Health Protection. The Oregon Psilocybin Services Section will implement Ballot Measure 109, which was passed in November 2020 and directs the Oregon Health Authority to license and regulate the manufacturing, transportation, delivery, sale, and purchase of psilocybin products and the provision of psilocybin services. The Oregon Psilocybin Services Section will begin accepting applications for licensure on January 2, 2023. Until then, the Oregon Psilocybin Services Section is in a development period, working to build the nation’s first regulatory framework for psilocybin services.
